For non-prof BCs under the American tax code......

1. Can a family be required to join the BC?

2. Can first year families be required to participate in the BC while being required to pay for the benefits that the BC is paying for all other families?

3. Is it legal for a BC to exclude first year families from partaking in the benefits on the premise that they did not fundraise so they are not eligible to receive BC benefits?
 
1. Membership cannot be compulsory, but the gym is not a NFP, so there's some gray area regarding whether they can require it.

2. Sure.

3. You cannot have a relationship between an individuals contributions or fundraising and their benefits. You can, however, have a relationship between level, achievement, etc and benefits.
 
1. Our BC is a completeyl separate entity. It is not part of the gym. We have to join our bc separately. That being said, we don't have to join either.

2/3 are different for me, and I have no idea. we havea 6month "vesting" period, and then we get full benefits. We don't pay dues at all.
