I'm an employment lawyer. I am licensed in Texas, but I have tried wrongful termination cases all over the country. And I cannot believe the complete bs I am reading here.

First, anyone can file for unemployment. And the states typically go out of their way to find in the employee's favor so that they qualify for assistance. This IN NO WAY invalidates the termination decision that was made. And unemployment rulings are completely inadmissible in wrongful termination cases.

The DOL will never take action against an employer for term'ing someone who is in good faith suspected of being a risk to the kids. But the EEOC will absolutely take action against employers who turn a blind eye to suspected molestors.

Most people who document poor performance before taking action do so in order to comply with company policies. It is to ensure a fair, good faith decision was reached. Is that really such a bad thing? To have a policy to treat people fairly?

But anyone who thinks employment laws in the US (which are the weakest of just about any country out there) prevent businesses from employing abusers is simply wrong. It is an excuse not grounded in reality.

Just watched it......so sad and heartbreaking that these girls (and any child) had to go through such abuse at such a young age.

DH and I spent a lot of time talking to DD about good vs bad touching. Hope she understands when in doubt, tell us.

My understanding from his defence is that he was carrying out medical treatment, and valid, licensed medical practices.
There may well have even been a chaperone in the room.

Obviously in hindsight several of the gymnasts have either realised that a) intravaginal adjustment, even though it may be licensed as a treatment, is not appropriate for young gymnasts, as I presume there would be some fairly major consent issues for U18's, and b) carrying it out without gloves is a major breech.

A chaperone could well be present, but not know if parental consent has been given, or with a direct view to see gloves etc.

It has been reported that there were no "chaperones" present -- assuming you mean a third party in the room during the procedure. He was disciplined by MSU for not following that protocol and that is what eventually led to his firing. One victim reported that he did this to her while her mother was in the room, but positioned himself in such a way that the mother could not see what was happening. Others have reported that this happened 1:1, with no one else present.

Also, there was no prior consent given for this type of "treatment" as is the standard for invasive types of care. This should have never been done, even in a medically appropriate way, without full review of the procedure and prior written consent. Parental consent for those under 18. Based on all the information I have seen thus far, that never happened with any of these patients.

I can tell you as someone who has sent her kids to the Ranch in the past on a pretty regular basis for a while, I signed some blanket type USAG medical consent for treatment in case they are injured while there ( and we always sent their regular JO coach that went with them a specific notarized consent to treat for the coach , in case they needed to access care while traveling)....

I never had any idea this type of behavior was going on there and according to my daughter, Nassar never came into her cabin but the female physical therapist often did to administer treatments to the gymnasts...and that folks, was news to me. I said, "they did PT treatments in the cabins?" And she looked at me as if I was speaking Greek and said "sure, we were hanging out there so she came to us"... mind you, coaches aren't supposed to be in the cabins but medical folks were ok I guess. Thankfully for us, my girls never had any injuries that needed any treatment while there...

I would imagine going forward , things will be much more transparent about what goes on at the Ranch...

I wonder if these gymnasts went home and told their parents what was happening but the parents thought it was a legitimate medical exercise and didn't think to ask if he used gloves, there was a witness, or whatever. It just seems like such a large number of girls that it would be a miracle if nobody mentioned it to their parents or personal coach, don't you think? And the kids would have no reason to keep it a secret if they thought it was a legitimate treatment.

According to her, no the coaches weren't supposed to be in the cabins.

And from what I saw on 60 minutes last night, it doesn't sound like the gymnasts told anyone because they were told it was a treatment protocol designed to help them. I read in an Indy Star article I believe, that Nassar even did these things with a parent present for the exam....he would position himself between the gymnast and her parent. We know one AT that worked with him and is just sick that it happened and none of the AT staff ever suspected it....so Nassar was quite the sicko and adept at what he was doing...

Andy Memmel said that he was not allowed in his own daughter's cabin. Those creeps are very skilled at hiding what they are doing. I know a family where the mom was physically abusive and she got away with it for years.
