Hi all!

Hopefully someone knows the answer to this. Our booster recently did a fundraiser to help with the cost of a camp. The fundraiser made $1400. The boosters are saying they are only giving $1k of that towards the purpose of the fundraiser and keeping $400 of that as a “cushion” for future expenses. Is this legal or must all of the money be put towards the stated purpose of what the fundraiser was for?
 
While it is perhaps morally questionable if they received donations under the premise of the funds going to an explicitly stated thing and then not spending it all towards said purpose, if it is a not-for-profit, it is not illegal. NFPs only receive that status because they are working towards some community good. So as long as they are spending that money in support of the community purpose (gymnastics camps, competitions, etc) they are within line.
